The
Product Registration Program is responsible
for the registration of each and every
pesticide product sold and/or distributed
in Kentucky. A $125 fee is assessed
for each new pesticide registration
(prior to sale or distribution) and
the renewal of each pesticide registration.
Product registrations expire
December 31st of every calendar year.
KRS 217.570 states that every pesticide
product must be registered with the
Kentucky Department of Agriculture,
Division of Pesticide Regulation,
prior to being sold or distributed
in this state. All FIFRA Section (3)
registrations expire on December 31st
of each calendar year.
KRS 217.570(2)(c) requires a finalized
copy of each product label to be on
file with this department. Please
remit the EPA "stamped" approved label,
a complete final label and an MSDS
sheet for each and every new product.
According to KRS 217.544(26),
"Pesticide" means any substance or
mixture of substances intended to
prevent, destroy, control, repel,
attract, or mitigate any pest; any
substance or mixture of substances
intended to be used as a plant regulator,
defoliant, or desiccant; and any substance
or mixture of substances intended
to be used as a spray adjuvant. According
to KRS 217.544(31), "Spray Adjuvant"
means any wetting agent, spreading
agent, sticker, deposit builder, adhesive,
emulsifying agent, deflocculating
agent, water modifier, or similar
agent intended to be used with any
other pesticide as an aid to the application
or to the effect thereof, and which
is in a package or container separate
from that of the other pesticide with
which it is to be used. Spray adjuvants
shall be registered to comply with
KRS 217.544(31).
KRS 217.570(3)(a) requires an annual
fee of one hundred twenty-five dollars
($125.00) for each and every brand
or grade offered for sale in this
state. This means that if you distribute
a product under more than one brand
name or grade in Kentucky, then you
must register each product separately
and pay the fee for it regardless
of whether or not the products bear
the same EPA registration number.
KRS 217.570(7) provides for a ten
dollar ($10.00) additional fee to
be added to the original fee if a
product is not registered prior
to January 15 of any year, or
if found sold or offered for sale
prior to its registration. |
