FRANKFORT, Ky. — The Kentucky Department of Agriculture has advised Kentucky retailers that charging any price for motor fuel other than the price shown on the pump is prohibited by state and federal law.

The Department issued a memorandum to retail motor fuel establishments in response to inquiries. The memorandum states that devices that will not compute with a total unit price above $2.999 per gallon must be modified to compute the higher per-unit pricing before they are placed into service. Devices that are found in violation will be taken out of service until they have been modified, the memorandum says.

As fuel prices have escalated in recent days, the Department has accelerated its inspections of motor fuel pumps for accuracy of delivery and pricing, said Tom Bloemer, administrative manager of the KDA’s Weights and Measures Branch.

Bloemer said Department inspectors are watching for indications of price gouging and are reporting possible cases to the Kentucky attorney general’s office. Citizens who wish to make a complaint of price gouging may contact the attorney general’s office by e-mail at gaspricecomplaints@ag.ky.gov.
